Entry-Only Listing Agreements, CCMLS Compensation

 

TYPES OF LISTING AGREEMENTS:

  • The PPMLS does not dictate what type of listing agreement is entered into between the broker and the seller.  However, the PPMLS will only accept Exclusive Right to Sell, Lease, or Exchange or Exclusive Agency listings.  The PPMLS does not accept “open” or “net” listings. 

SERVICE LEVELS:

  • The PPMLS accepts Full Service, Limited Service, and Entry-Only listings, but only when the listing broker has secured either an Exclusive Right to Sell, Lease or Exchange, or an Exclusive Agency listing agreement.
  • Listings that have been submitted to the PPMLS in the absence of an Exclusive Right to Sell, Lease or Exchange, or an Exclusive Agency listing agreement will be deleted from the PPMLS database.
  • As an example, if a broker has entered into a “marketing agreement” with a seller, and has input the property into the PPMLS as an EO-Entry Only listing, that listing will be deleted from the PPMLS database if it has not been secured by either an Exclusive Right to Sell, Lease, or Exchange, or an Exclusive Agency listing agreement.

COMPENSATION:

  • The PPMLS is a means by which authorized Participants make blanket unilateral offers of cooperation and compensation to other Participants.
  • Such offers are unconditional except the entitlement to compensation is determined by the cooperating broker’s performance as the procuring cause of the sale (or lease or exchange) or as otherwise provided for in the rules.
  • CCMLS – Colorado Cooperative MLS listings.  Through a license agreement with Participating MLSs, listings from these MLSs are exchanged and their Participants’ offers of cooperation and compensation are extended to Participants of the Participating MLSs. 
  • Some brokers use listing agreements with addendums that state that the unilateral offer of compensation is not extended when the procuring cause agent participates in another MLS.    Please note that these clauses are not applicable to properties offered through the CCMLS!
